Software Provided "AS IS" — Albertastudio Limitation of Liability

1. Disclaimer of Warranties ("AS IS" Standard)
Explicit disclaimer of operational, technical, and mathematical guarantees under Canadian Law.
The "Animal Shelter Manager" application is provided by Albertastudio on an "AS IS" and "AS AVAILABLE" basis without any express or implied warranties.
- No Guarantee of Uninterrupted Operation: Developers do not warrant that software access will be uninterrupted, error-free, or exempt from server maintenance downtime.
- No Fitness for Particular Purpose: Developers make no claims regarding compliance with specific municipal, provincial, or veterinary regulatory audits beyond the technical capabilities supplied.
- No Absolute Data Retention Guarantee: Developers do not guarantee immune protection against client-side browser cache wipes, operating system cleans, or third-party cloud hosting disruptions.
2. Complete Limitation of Developer Liability
Release of developers (Albertastudio) from material, financial, and legal claims.
To the maximum extent permitted by the laws of Alberta and Canada, Albertastudio and its developers shall not be liable for any direct, indirect, incidental, or consequential damages including:
Data Loss & Corruption
Any loss or damage to IndexedDB, LocalStorage, or Supabase records caused by hardware failure, network outage, or browser wipes.
Human Entry Mistakes
Incorrect dosages, erroneous financial entries, typos, or inaccurate adoption documents entered by shelter staff or volunteers.
Offline Sync Conflicts
Data overwrite conflicts arising when offline device caches reconcile with cloud database tables.
Consequential Losses
Financial disputes, missed grant deadlines, lost donations, or third-party claims against the Organization.
3. Organization Data Backup Responsibility
THE SHELTER ORGANIZATION BEARS SOLE AND UNCONDITIONAL RESPONSIBILITY FOR REGULAR MANUAL DATA BACKUPS.
Organization administrators must use the JSON and CSV export tools provided in the /settings and /reports pages to save external data snapshots on a weekly basis. Albertastudio accepts zero financial or technical liability for unbacked-up records.
4. Maximum Liability Cap ($100 CAD / 12-Month License Fee)
IN ANY EVENT, THE AGGREGATE LIABILITY OF ALBERTASTUDIO ARISING OUT OF OR RELATED TO THE USE OF THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE ORGANIZATION TO ALBERTASTUDIO FOR THE SOFTWARE LICENSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS LOWER.
5. Class Action & Representative Lawsuit Waiver
THE ORGANIZATION AGREES THAT ANY DISPUTES OR CLAIMS AGAINST ALBERTASTUDIO MUST BE RESOLVED ON AN INDIVIDUAL BASIS AND WAIVES ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
6. Privacy Policy (PIPA Alberta & PIPEDA Canada)
Strict compliance with Canadian personal information collection and processing regulations.
Data Controller vs. Data Processor Roles
Organization (Shelter) as Data Controller: The Organization is responsible for obtaining valid individual consent from adopters, volunteers, staff, and donors under Alberta PIPA prior to recording their personal information.
Albertastudio as Data Processor: Albertastudio provides technical software infrastructure only. Developers never sell, monetize, analyze, or share stored shelter data with third-party advertisers or research entities.
Data Protection Measures
- HTTPS / TLS 1.3 encrypted data transmission for all client-server communications.
- Row-Level Security (RLS) policies isolating organization records in the database.
- Encrypted database connections and secure client authentication tokens.
